Finally, the Supreme Court on Tuesday settled all matters arising from the Osun governorship election of July 16, 2022, when it dismissed all evidence adduced by Petitioners to prove over-voting in the election and also cleared the incumbent Governor Ademola Nurudeen Jackson Adeleke of allegations of certificate forgery.
In their judgement, Justices of the Supreme Court held that the Court of Appeal was in order to have reinstated Adeleke as Governor having been removed earlier by the Governorship Tribunal.
The Panel of Justices led by Justice John Okoro while delivering its judgement, prepared by Justice Emmanuel Agim dismissed the appeal filed by the candidate of the All Progressives Congress, Alhaji Isiaka Adegboyega Oyetola.
In the landmark judgement, the Supreme Court ruled that the register of voters is very cardinal and relevant to accreditation and that without it, overvoting cannot be established.
Since the BVAS is the foundation of the Appellants’ case, failure to produce the BVAS was fatal. The Supreme Court also also held that INEC regulations does not provide for transportation of accredited voters to the database except snapped pictures of results for form EC8A to the IREV.
Pw1 held out by the Appellants as an expert relied on hearsay evidence, his evidence was not admissible. Appellants as the petitioners did not discharge the burden of proof cast on them by law. Appellants as petitioners relied on a “3rd hand record” to claim overvoting. The Court of Appeal was correct in setting aside the decision of the Tribunal.
