Court Grants Seun Kuti Bail After 48 Hours Remand, Police Comb Home for Evidence

A magistrate court in Lagos has remanded the son of the legendary musician, Mr. Seun Kuti in Police custody for 48 hours after his arraignment for allegedly assaulting a police officer. But, he was ordered to be released on bail after the period during which the Police should have conclude its investigation.

But, the Police is not letting up as a detachment of the Force stormed Mr. Seun Kuti’s home for incriminating exhibits to nail him for other offences. The Magistrate had earlier asked the Police to conclude its investigation and hand over the file to the Director of Public Prosecution for necessary action.

Magistrate Adeola Olatunbosun of the Yaba magistrate court gave the verdict on Tuesday following the police decision to arraign Mr Kuti, praying the court to remand him for 21 days to conclude its investigation, pending legal advice from the directorate of prosecution.

Mr. Seun Kuti has been in the eye of the storm since his altercation with a policeman. The Inspector General of Police ordered his arrest but he turned himself in on Monday. The police charged him with a crime of assaulting a police officer in violation of section 356 of the Nigerian Criminal Code Act. He was arraigned surreptitiously taken before a Yaba Magistrate’s Court for assault on a police officer, an offence contrary to Section 356 of the Nigerian Criminal Code Act without notifying his Lawyers.

However, Mr Kuti’s counsel, led by human rights lawyer Femi Falana, claimed they were unaware of the remand application and asked the court to disregard the prosecutor’s prayer.

Meanwhile, in her judgment, the magistrate ordered the police to release the defendant from their custody after 48 hours. “Court has decided to override any public opinion and pass the judgment of the court.

“Following the remand application presented before the court, I am advising that the case file be duplicated and sent to the Directorate of Public Prosecutions within 72 hours.

“The defendant is hereby remanded for 48 hours in police custody to allow the police to conclude their investigation.

“After 48 hours, the defendant will be granted bail in the sum of N1m with two responsible sureties, a three years tax payment receipt that is verifiable; one of the sureties must have a landed property within the court jurisdiction.”
