Dr. Abiye Sekibo who was the first witness tendered a letter addressed to him by the National Organizing Secretary of the PDP. It was admitted in evidence by the court.
Dr. Sekibo under cross – examination by INEC Lead Counsel, Mr. A. B. Mahmood, Senior Advocate of Nigeria (SAN) said he visited about 20 polling units and election results were not uploaded in all the Polling Units. “I visited about 20 polling units and in all those Polling Units, they couldn’t upload. Results written couldn’t be uploaded. It was the same across the state”, he said.
Asked by Chief Akin Olujinmi SAN whether he was physically present or not in the right local government areas where he said disturbances made him to avoid, Dr. Sekibo said: “present is relative. I was not present in all of them”.
The PDP chieftain confirmed that he did not mention the figures credited to PDP in paragraph 6 of his witness statement on oath adding that he also did not mention the names of the agents who perfected the disturbances in some local government areas.
Alhaji Mohammed Babaji Madaki the Chairman of PDP in the Federal Capital Territory (FCT) who said in paragraph 14 of his witness statement on oath that a presidential candidate must win 25 percent votes in an election before he or she could validly win the election confirmed that Alhaji Abubakar, his candidate, did not score 25 percent.
Under Cross Examination by INEC Lead Counsel Mr. Mahmood, the witness witness confirmed that since Alhaji Abubakar did not have 25 percent of votes in the FCT, the PDP Presidential candidate like President Tinubu are not entitled to be returned as President -Elect.
Alhaji Madaki while answering a question from President Tinubu’s counsel to the APC, Chief Olujinmi said he was aware that Presiding Officers are the only ones that upload results all over the country.
Prince Lateef Fagbemi, lead counsel to the APC asked the witness whether FCT is like a state on its own to which the witness answered in the affirmative.
Abraham David, a business man who lives in Karamajiji, FCT and acted as PDP Collation Agent in the FCT under Cross Examination by the INEC counsel confirmed that Alhaji Abubakar scored 15percent votes in the presidential election.
Chief Olujinmi, the APC counsel asked the witness why he did not indicate what is “unlawful votes?”, he asked the witness pointedly:” Did you state unlawful votes?” to which the witness said :”No”.
The APC Counsel asked the witness whether he wrote his written statement on oath together with Alhaji Madaki because both were the same, the witness said he wrote his statement separately.
“I wrote out the content of my written statement on oath myself”, he told the court. Cross examined by Mr. Rotimi Ogunsola, counsel to APC, Mr. David told the court that he was not a Collation Agent at the ward and local government level.
The fourth witness presented by the PDP on Monday, Mr. Ibrahim Muhammed Hamza, a Human Resource Consultant informed the court that the Collated results from Nasarawa state which he signed was different from the one he signed which was clean without any cancellations unlike the one he was shown on Monday.
Under Cross Examination from Mr. Mahmoud the INEC lead Counsel, Mr Hamza said the BVAS system failed in his polling unit: “even in other polling units”.
Mr. Mahmoud asked the witness that he did not state that he signed the result marked Exhibit PC 25 under duress, the witness answered in the affirmative.
“You alleged that it was altered, where is the one you signed?” Alhaji Hamza informed the court that the one he has is with his party.
Chief Wole Olanipekun asked the witness whether he has any other result apart from the one already admitted in evidence, the witness said :”yes”, stressing that the result is with the National agent.
Counsel to APC, Chief Niyi Akintola asked the witness why he never tendered anything from INEC that he was a Collation Agent , the witness said :” I don’t have anything”.
The case was adjourned to Tuesday.
